The District intends to award to AP Construction Group, Inc. at the 11/18/2020 board meeting

Please refer to Document 00 52 13 Agreement, Item 6 “Liquidated Damages” which states “Contractor agrees that is shall pay to the District the sum of Five Thousand Dollars ($5,000.00) per day as liquidated damages for each and every day’s delay beyond the time herein prescribed in finishing the work.” Item 16.1 of Document 00 72 13 General Conditions, Paragraph 16.1 Liquidated Damages states “Contractor shall pay to the District as fixed and liquidated damages, and not as a penalty, the amount set forth in the Agreement for each calendar day of delay in completion ($2,000.00). Please clarify which is correct, $5,000 or $2,000.

Please refer to Document 00 72 13 Genera Conditions, Paragraph 13.1.5 Builder’s Risk Insurance: Builder’s Risk “All Risk” Insurance which states “School District provides “All Risk” Insurance. Prime General Contractor responsible for deductible portion.” Please clarify dollar amount of “All Risk” Insurance deductible.

The deductible for the “all risk” or builders’ risk insurance is $10,000.00.

We wanted to get clarification on instructions to bidders #2 document 00 21 13. 2. The District has prequalified bidders pursuant to Public Contract Code section 20111.6 for contracts $1 million or more using or planning to use state bond funds. Only prequalified bidders will be eligible to submit a bid for this Project. Any bid submitted by a bidder who is not prequalified shall be deemed nonresponsive and will not be considered. Moreover, any bid listing subcontractors holding C-4, C-7, C- 10, C-16, C-20, C-34, C-36, C-38, C-42, C-43 or C-46 licenses, and if used, who have not been prequalified, shall be deemed nonresponsive and will not be considered. Are we able to list any subcontractor holding C-4, C-7, C- 10, C-16, C-20, C-34, C-36, C-38, C-42, C-43 or C-46 licenses that are on the list of prequalified contractors regardless of their approved for amount as long as we, as the prime contractor, are approved for the amount of the project? For example, if a HVAC subcontractor is approved by the Oxnard Union High School District for $1,000,000 can we, as the prequalified prime contractor for $25,000,000, list them as a subcontractor for a scope exceeding $1,000,000?

No, the subcontractor with licenses listed holding C-4, C-7, C- 10, C-16, C-20, C-34, C-36, C-38, C-42, C-43 or C-46 are required to be pre-qualified for the value of their portion of work (Separate from Primes Pre-Qualification).

Are all existing 1st and 2nd floor decks in all associated buildings covered with monocoat fire proofing? Will the owner be open to providing an allowance for monocoat patch back as it is very hard to quantify what will be required at bid time in order to level the playing field between the bidders.

Contractor to assume all deck systems have monocoat fire proofing. The amount of penetrations and repair is not quantitative, due to unknown approach of contractor means and methods. Owner will not be providing an allowance to patch back monocoat.

Clarification regarding bid bond

The original bid bond provided in the Bid Documents for Bid 639 PHS New HVAC Modernization is sufficient for use by all contractors. Although Addendum #2 updated Division 0, it changed nothing in the bid bond document.
